The Platta Law Firm, PLLC, represents the family of Stanislaw Supinski who died in a New York City construction accident last week. Our office is in the process of conducting a thorough investigation of this construction accident. Preliminary reports indicate that Mr. Supinski and the other worker injured in this construction accident were performing asbestos abatement on excavated debris near an unsecured wall of a previously burned and structurally unsound synagogue while an excavator was being operated nearby. This excavation work caused the unsecured wall to collapse onto these two workers and caused Mr. Supinski’s untimely death. These two workers should not have been permitted to perform this asbestos abatement work while excavation work was being performed nearby. It appears that the negligence of the owner and general contractor directly caused this accident and Mr. Supinski’s tragic death.
Our office has a proven track record of prosecuting lawsuits arising from construction site accidents. In 2011, our firm took a case to the Court of Appeals (Wilinski v. 334 East 92nd Hous. Dev. Fund Corp., 18 N.Y.3d 4) which expanded the scope of the laws that protect construction workers in New York State. The precedent set in Wilinski has been used by plaintiffs across the state and will also be applicable in this case. We take this work seriously and will work side by side with OSHA, the New York State Department of Labor, and New York City Department of Buildings to get to the bottom of this tragedy. We will do everything in our power to ensure that Mr. Supinski’s family receives justice.
